DECLARACIÓN DEL PUEBLO MAM “LIBRE DE MINERIA (Región de Huehuetenango)"

On May 18, 2011, in a mass event held among the temples of Zaculew, the pueblo Maya-Mam of Huehuetenango declared themselves free from mining. In the presence of community, municipal, and ancestral authorities from the Mam area itself, as well as delegations from other departments, the "Declaration of the Mam People Free of Mining" was read. We: men and women, sons and daughters, granddaughters and grandsons of K´aib´il B´alam, authorities and community organizations that make up the Council of the Western Pueblo Maya (CPO) and municipal authorities; gathered in our spiritual and political center Zaculew, on the day 6 Noj that marks our ancestral calendar, to determine the following:

 

CONSIDERING:
 

We are the Pueblo Maya-Mam and our existence has been maintained in time and space for thousands of years. Today we are two million inhabitants, we have preserved our mechanisms of participation and coexistence; Zaculew is a historical reference of our spirituality and political center, heritage and patrimony that has been taken from us and that we are currently politically reclaiming.
 

CONSIDERING:
 

That our territory has immense wealth in biological diversity and transcends borders and geographic limits imposed by colonization for more than five hundred years; Currently, we are under the threat of a new transnational invasion, which with the discourse of "development," national and transnational companies, in complicity with the governments in power, intend to snatch away our natural resources that belong to us by ancestral inheritance.
 

CONSIDERING:
 

That the State of Guatemala, in complicity with national and transnational companies, has systematically violated the rights of our collectives by authorizing, without prior consultation and without our consent, licenses for mining exploitation, construction of hydroelectric plants and other mega-projects in our territory, privileging the interests of national and transnational companies.
 

CONSIDERING:
 

That the Pueblo Maya-Mam of: Colotenango, Ixtahuacán, La Libertad, San Sebastián Huehuetenango, Santa Bárbara, San Gaspar Ixil, San Pedro Necta, Santiago Chimaltenango, San Juan Atitlán, Todos Santos Cuchumatan, San Rafael Petzal, Cuilco, and Tectitán, respectively; making use of our values, norms, organization, and through the process of dialogue and community consultations of good faith (consultas comunitarias de buena fe), in consensus, have made the decision to categorically reject the new transnational invasion; our consultations were carried out using national and international legal instruments, approved and recognized by the State of Guatemala.
 

CONSIDERING:
 

That the State of Guatemala, making use of colonial, neoliberal, and bad faith mechanisms, intends to ignore our decisions issued in the Community Consultations; and to disqualify this legitimate process, the current government intends to impose a consultation regulation that minimizes and distorts the spirit of consultations, from our worldview.
 

Therefore:
 

In general assembly and in harmony with our grandmothers and grandfathers, with full political clarity towards the search for our self-determination as an Indigenous people, it is an inalienable right;
 

WE RESOLVE:
 

We declare Mam territory “Free from Mining,” free from the plundering and usurpation of our natural resources; we propose to build our own processes of political, social, economic and cultural rethinking, based on our worldview, knowledge, and ancestral practice.
That we, the 13 municipalities that make up this Mam territory, will fight tirelessly to manage our common well-being and defend our territory collectively, against any aggression or threat that alters the integrity of our territory.

 

That we will work together to advance towards our territorial, economic, and political autonomy, since dependence has caused stagnation and deterioration of our collective life as Mayan peoples, and that in the near future we will rebuild the Mam family separated by the geographical limits imposed by the colonial, neoliberal system.
 

We declare as “unwelcome” those people and institutions that lend themselves to the game and interests of the government and businesspeople attempting to unilaterally regulate community consultations and compromise our territories.
 

We intend to recover our spiritual and political center Zaculew, which by historical right belongs to us, so we will not allow another attempt at intervention and looting as they did in previous years, but above all racist opinions that question its originality and historical continuity with the Mayan people who are its grandchildren.

 

This Declaration enters into force immediately.
 

Given in our spiritual and political center Zaculew on the 18th day of the month of May, 2011.

The MAM NATION: We Decide our Autonomy and Self-Determination

We are the most ancient Pueblo of these territories, hence the name Mam which originates from Chmanb'aj - Mamb'aj, which refers to the relationship between grandparents and grandchildren, the relationship between current and future generations.


Today that we are in the day Junlajuj B'e, August 5th, 2014, constituted in the Assembly of the Mam Nation, we resolve the following:
 

Once again we invoke the name of our ancestors, creators, and formers to strengthen our process of reconstituting our nationality and territory and the exercise of Good Governance (Buen Gobierno).
 

That our Ancestral Territory goes from Chnab'jul Huehuetenango, Mlaj Retalhuleu, Txeljub' Quetzaltenango, Txe Chman San Marcos, and Jlaj Chiapas, that we are going to defend it from any threat from transnational corporations. We are moving towards the recovery of our ancestral territories and cities, among which we highlight Saq tx'otx', and Abaj Tajalik, and those located in Soconusco, such as the archaeological zone of Izapa in the municipality of Tuxtla Chico, Chiapas, Mexico, a territory that from hence forth we are going to recover.
 

We categorically reject the imposition of mining and hydroelectric licenses in all our territories, which we have already decided on through the more than 35 Community Consultations (Consultas Comunitarias de Buena Fe) that we have carried out within the framework of laws and International Conventions such as ILO 169.
 

Today we stand in solidarity with the people of San Martín Chile Verde in their struggle to defend their territory against the imposition of the Hydroelectric project that has been operating without the consent of the people.
 

We agree and state that the Council of the Mam Nation is the only political body that can be consulted and resolve any policy, program, or project in our territories. It is also our body in the process of Articulation of the Mayan People in Guatemala and its coordination with other peoples at the national and international level.

The Indigenous peoples of this territory K’AYB’IL B’ALAM, reject and condemn in the strongest terms the unacceptable behavior of Lic. María Consuela Porras, head of the MP, in abusively ordering the dismissal of the investigating corruption prosecutor, Juan Francisco Sandoval of the FECI. He is a person of good will with extraordinary work and capable of finding true justice and democracy for the people, tirelessly investigating what the system of corruption is; knowing that corruption is completely collapsing Guatemala due to so much impunity in the theft of resources from the pueblos.​​

​

In view of this situation, we strongly demand that the powers of the state:

​​

  1. That the decision to dismiss Attorney General Juan Francisco Sandoval, by María Consuela Porras of the MP, be annulled.

  2. That the Attorney General Juan Francisco Sandoval returns to his position with normal functioning, with full guarantee of his safety, that of his family members, his work team within the FECI, and of all the people in the fight against corruption.

  3. That a thorough investigation be opened into those involved in the decision to dismiss Juan Francisco Sandoval, the key FECI member; but, first of all, into Lic. María Consuela Porras, for the crimes committed in executing such a regrettable decision. Prinicpally, the illegality she may have committed outside the Political Constitution of the Republic and the internal law of the MP.

  4. With this decision to remove him, instead of moving forward, we are going backwards in terms of the economic, social, and cultural development of our pueblos in Guatemala.

  5. A call to the corrupt system, CACIF, drug traffickers, and the entire mafia, who are burying Guatemala, to stop all their abusive and destructive posture towards the harmony of the pueblos of Guatemala.

  6. We ask the international community and the Human Rights community for their unconditional support in ensuring true justice for the Pueblos of Guatemala and in severely punishing those responsible.

  7. We call upon the municipal, community, women's, student, merchant, church, truck drivers, transporters, athletes, tuk-tuk drivers, ancestral authorities, midwives, municipal teachers, health workers, academics, and youth at the departmental and national level to urgently organize ourselves and join the national strike, as this is the only option and alternative for the powers of the state to listen to the people of Guatemala.

  8. As a result of corruption, Giammatei's strategy was to take advantage of the COVID-19 pandemic to strengthen his policy of increasing the price of basic necessities, gasoline, tickets, and medicines, among others.

  9. Construction owned by Giamamattei in Santa María de Jesús on the slopes of the volcano Agua and Palín Escuintla. It is valued at 11,263,425.60 million dollars for the construction of the president's house, an anti-virus, anti-demonstration, anti-war, anti-disaster design. But what hurts the most is that he is building it with the people's money, we have to pay that price. With what right and consultation is there to spend our money in that way?

Public statement, from the Maya Mam Saq tx'otx' Council, which brings together the 13 municipalities of the Mam area of Chnab'jul, community authorities and social organizations. We have gone through several centuries of life, after the bleeding by the Spanish against us, unfortunately we can only express that we have been living and carrying on our shoulders and backs the abuses of life, being slaves to them, servitudes, discrimination, exclusions, and miseries at all levels of life.


We see that the rich and the governments in power enact laws in their favor and protection, while in some articles there is a percentage that protects us, but the rich distortedly with endless arguments and justifications, exclude us from their laws [and protections].


We have an international law, ILO Convention 169, which protects us and through it we organize ourselves to demand our social, economic, cultural, and political development.


Likewise, grandmothers and grandfathers have passed down customary law to us and today we are putting their teachings and valuable knowledge into practice to protect our lives and territories. One of them is our hero K’ayb’il B’alam.


The Leadership Board of the Maya Mam Saq tx’otx’ Council and community authorities and social organizations, in full assembly today, August 9th, International Day of Indigenous Peoples, have decided to declare the historical vindication of the great Mam warrior leader of Huehuetenango, K’ayb’il B’alam, to strengthen our organizations. We are committed to instilling in our veins and convictions his indisputable history, to continue to pass on to our sons and daughters, grandsons and granddaughters, and great-grandsons and great-granddaughters of the pueblo Maya Mam.


The governments in power never recognize the great resistance of K'ayb'il B'alam, for bravely resisting and defending the Saq tx'otx' territory; which means white land. In the year 1532, he reigned the Mam territory at 31 years of age, captaining a resistance of 18,000 Mam warriors. He never surrendered on the battlefield, attack after attack with the Spanish, freeing the Mam capital, and it remains today the Capital of the Mam people. This is how we recognize him: immortal.

For this reason, today our Assembly of the Pueblo Mam decided to give political recognition to K'ayb'il B'alam as our NATIONAL HERO for today and always.
